This accident occurred within the grounds of Concord Hospital in Concord, NH when the Defendant operator improperly and without care backed from a parking space and struck the vehicle operated by the Plaintiff. The impact caused the Plaintiff whipped both sideways and back and forth within the vehicle causing injury to her neck and aggravation of an ongoing low back condition. She exited the vehicle to address the Defendant and as she returned to retrieve information from her glove box to exchange, he left the scene. Fortunately, the parking lot was patrolled by security personnel who contacted the Concord NH police who later tracked him down. Following investigation the police officer determined that the Defendant was at fault.
The police report indicates that the Plaintiff reported neck pain at the scene and while she refused treatment at that moment she ultimately was taken to the emergency department by the security officer. She was appropriately examined and diagnosed with neck and back pain secondary to the motor vehicle accident. She was referred to her own physician. The Plaintiff did not lose wages but was restricted in her normal activities and endured significant pain and suffering throughout the period of treatment. She continues to suffer residual symptoms and her neck pain is easily aggravated.
